Objectives Foundation Judiciary Institutes Windward Island

1.  To carry out rehabilitation activities, namely to look after the interest of those persons who have received a suspended or a definitive sentence, or persons threatened by the Judge with an imposed punishment, as well as those who have been put under the care of the Foundation by the Public Prosecutor.

2. To offer a lasting care to minors in the Windward Islands, namely: to provide guidance and assistance to family guardians and mentor employers, even after the release of the supervision and to provide preventive assistance to the family and the minor in order to avoid legal supervision.

F.J.I.W.I.: consists of 2 offices:
1. Rehabilitation: probation and aftercare
2. Family Guardianship: supervision and aftercare

Rehabilitation: probation and aftercare
The office assists people who are suspected or have been consisted of an offence to deal with any problems they may have. The worker helps in the process of rehabilitation and tries to prevent people from re-offending. They offer individual attention and draw up a plan to deal with any problem. For people who have been sentenced for an offence, the plan includes activities such as alternative sanctions, which the office supervises.

Core tasks:

  • Inform Judge and / or Public Prosecutor Office concerning the personal circumstances of suspects, advise and exercise supervision.
  • Visiting detainees / suspects and residential visit's.
  • Promote decent behavior of detainees.
  • Reduce obstacles which delinquents encounter in the society after trial or detention.
  • Psycho-social guidance of ex-detainees.
  • Assistance / mediation in securing employment , housing and medical insurance.
  • Organization and execution of Community Service and Electronic Supervision.

Family Guardianship: supervision and aftercare
The office is the first on Sint Maarten that explicitly dedicates itself to the execution of the measure of placing minors under supervision, as it is visualized in her objective to render help to parents, guardians and members of the family with the education and care of minors who have been “placed under supervision” by the Judge, as much as possible in their own surroundings. The Family Guardianship, just like the Court of Guardianship is under the jurisdiction of Justice. The most important means to this is the functioning of the Office as a central institution for enlisting, selection and guidance of family guardians.

Core tasks:

  • Function as an institution of guardianship.
  • Recruitment, selection, guidance and training of family guardians, parents and foster parents.
  • Provide and channel progress reports to the Juvenile Magistrate on “guardianship pupils” and “minors put under supervision”.
  • Social guidance of children placed under supervision and their family members.
  • Exercise work in the benefit of and on behalf of minors put under supervision i.e. enlistment in school, ensure professional guidance, medical insurance, residents permit, acquirement of legal documentation.
